These Terms and Conditions cover your use of the Book Of Memories websites (the “Website”)
along with other services offered (collectively called the “Services”). Front Runner Professional (“Company,” “we,” “us,” “our”) keeps the
right to change or update (the “changes”) any part of these Terms and Conditions whenever we need to,
without notice. Changes will be marked with the date they were last updated.
Changes will take effect at least fourteen (14) days after posting unless they relate to new features or legal requirements, which apply immediately.
If you continue using the Services after changes go live, that means you accept those changes fully.
Eligibility: Anyone under 18 can’t use the Services unless they have permission.
Users aged 13 to 17 can use the Services only if a parent or legal guardian over 18 agrees and supervises; also that adult must agree to these Terms and take responsibility for their use. The Company may refuse service or cancel any Campaign, Donation, or Service at any time for any reason without liability.
Definitions: Here “Campaign Organizers” means people raising funds, and “Campaigns” are their fundraising efforts. “Donors” means people giving money, and “Donations” are what they give. All Campaign Organizers, Donors, and visitors are called “Users.” Also, anyone named as a beneficiary in a Campaign is included under “Campaign Organizers.”
Services: The Services act as a platform (“Platform”) for Users to post Campaigns and accept Donations from Donors. Setting up Campaigns doesn’t cost anything upfront but each Donation has fees taken out by us and our payment partners. We may change or stop Services temporarily or permanently without notice – we won’t be responsible for losses if this happens. We aren’t liable if data uploaded gets lost or deleted either. If you access via mobile device, standard charges from your carrier apply; some features might not work on all devices or carriers. You agree we can contact you by SMS/MMS/text about Company info related to the Services.
Charitable Giving: Campaigns aren’t registered charities so Donations aren’t tax-deductible donations here. Donations might be processed through outside partners who deduct processing fees besides our own charges. You get that Company isn’t a charity itself nor asks for charitable donations on its own behalf – it just helps process payments between users here.
Administrative Platform Only: We’re simply facilitating payments between Campaign Organizers and Donors – not involved in their agreements directly – no broker/agent/financial institution role here whatsoever! We don’t control how organizers behave or verify what they say; we disclaim all liability on those fronts including campaign success/failure outcomes too. Donors decide themselves whether to donate after checking whatever info they want – all Donations are voluntary risks donors take alone; no guarantees on fund usage either! We don’t back quality/safety/legal status of campaigns either; donors handle tax stuff themselves concerning their gifts here exclusively.
No Verification of Campaign Information: We don’t check organizer info nor guarantee donations get used as described by organizers.
Your Registration Obligations: You might have to sign up with us before using some parts of the site.
When registering, promise truthful & current info about yourself when asked during signup form fill-out.
Organizers must register with real names/images representing them honestly.
Registration details & other info follow our Privacy Policy rules.
If under 13 years old? Sorry but no service allowed.
Under 18? Only with parent/guardian okay first.
Certain services require registration/agreement with third-party providers too – like payment processors – we’re not responsible for those third parties but might share info with them just so things work smoothly.
Public Display of Donations: Donors can choose if their donation shows publicly or goes private only seen by beneficiaries.
Just tick off privacy box while donating.

Payment of Donations: To donate you’ll provide credit card/payment details (VISA/Master Card/Discover/American Express).
You confirm your info is correct & authorized.
Minimum donation amounts might apply.
All payments final – no refunds.
Keep your account details current please.
By donating regularly through Platform billing options , you authorize advance billing until canceled.
Fees: No upfront fees charged by us for running campaigns.
We keep four percent (4%) from every donation (“Front Runner Professional Fee”).
Third party processors take additional processing fees:
• US Users ONLY pay 2.9% plus $0.30 per donation on VISA/Master Card/Discover cards,
or 3.4% plus $0.30 per donation on American Express cards.
• CA Users ONLY pay same fees as US users listed above.
All Fees get deducted right off each Donation before organizers receive funds.
We can update Fees anytime but will give notice at least fourteen days ahead online.
Continuing usage after Fee changes counts as accepting new Fees.
Indemnification:
You agree to protect & hold harmless Company + affiliates + owners + employees etc., against losses/damages/costs/lawsuits arising from your Service use/misuse,
breaking rules,
or messing with others’ rights.
If you’re in California, you waive Civil Code Section 1542 which says:
“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR
AT THE TIME OF EXECUTING THE RELEASE,
WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR”.
Residents elsewhere waive similar laws/doctrines.
DISCLAIMER OF REPRESENTATIONS AND WARRANTIES:
YOU USE SERVICE AT YOUR OWN RISK.
SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.
NO WARRANTIES EXPRESS OR IMPLIED – including merchantability / fitness / title / non-infringement guarantees.
NO PROMISES SERVICES WILL MEET NEEDS OR WORK UNINTERRUPTED OR ERROR-FREE.
WE CAN’T GUARANTEE ACCURATE RESULTS FROM SERVICES OR THAT DONATIONS REACH BENEFICIARIES AS PROMISED.
LIMITATION OF LIABILITY:
NEITHER COMPANY NOR AFFILIATES ARE LIABLE FOR INDIRECT/SPECIAL/CONSEQUENTIAL DAMAGES LIKE LOST PROFITS/DATA/GWILL EVEN IF WARNED ABOUT POSSIBILITY.
OUR TOTAL LIABILITY TO YOU NEVER EXCEEDS AMOUNT YOU PAID US IN LAST SIX MONTHS BUT NEVER MORE THAN ONE HUNDRED DOLLARS ($100).
EXCLUSIONS:
Some places don’t allow excluding certain warranties/liabilities so some limits above might not apply where you live.
If unhappy about anything here, your only option is stop using service.
DISPUTE RESOLUTION – ARBITRATION (READ CAREFULLY):
You agree disputes w/company get settled by arbitration except small claims court actions allowed.
To start dispute:
Send Notice describing claim + relief requested within sixty days before starting arbitration.

Arbitration follows AAA Commercial Arbitration Rules modified here.
Hearings usually held Chicago Illinois unless otherwise agreed.
