Kaitlyn "Katie" Breault Obituary - Amherstburg, ON

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE YOU USE THIS WEBSITE (AS DEFINED BELOW).
By accessing this Website, you agree to these Terms and Conditions.
If you don’t agree with them, PLEASE DO NOT use this Website (as defined below).

These Terms and Conditions apply to your use of the Book Of Memories websites (the “Website”)
and related services (together called the “Services”). Front Runner Professional (“Company,” “we,” “us,” “our”) reserves
the right at any time to change or update (“changes”) all or part of these Terms and Conditions for any reason.
When changes happen, we’ll note the date they were last updated.
Changes will take effect no sooner than fourteen (14) days after posting; except if they involve new features or legal reasons – those go into effect immediately.
If you keep using the Services after changes take effect, it means you accept those updated Terms and Conditions.

Eligibility: People under 18 can’t use the Services unless they have permission. Users aged 13 to 17 may use the Services only with consent and supervision from a parent or legal guardian who is at least 18 years old; that adult must also agree to these Terms and be responsible for how their child uses the Services. The Company can refuse anyone’s use of the Services anytime without any liability.

Definitions: In these Terms, “Campaign Organizers” are people raising money,
while “Campaigns” refer to their fundraising efforts. “Donors” are those giving money,
and “Donations” mean those contributions. Everyone using our Services – Campaign Organizers, Donors, visitors – are called “Users.”
Also, anyone named as a beneficiary in a Campaign counts as a Campaign Organizer.

Services: We provide a platform (“Platform”) where Users can post Campaigns
and collect Donations from Donors. Setting up Campaigns is free,
but we charge fees on each Donation for our service plus fees from third-party payment processors.
We may change or stop offering parts of the Services temporarily or permanently without notice.
You agree not to hold us responsible if this happens.
We’re not responsible if data or content gets deleted or isn’t saved properly by the Services.
If you access via mobile device, standard wireless charges apply; some carriers might block certain features.
By using our Services on mobile devices, you accept that we may contact you by SMS/MMS/text messages about Company info or related things.

Charitable Giving: Please know that Campaigns aren’t registered charities so donations aren’t tax-deductible.
Donations might be processed by an outside partner who deducts processing fees besides our own charges.
We want to make clear we’re not a charity ourselves nor do we ask for donations on behalf of charities;
we’re just facilitating payments between Donors and Organizers here.

Administrative Platform Only: Our role is only as a payment facilitator connecting Donors with Campaign Organizers,
not involved in any agreements between them directly. We’re not agents, brokers, banks, creditors,
insurers-just handling payments. We don’t control what Organizers say/do nor guarantee any results of campaigns;
so please understand that Donors decide entirely on their own whether to donate after doing whatever research they want.
All donations happen at Donor’s risk-we don’t promise funds will be used as stated or endorse campaigns’ quality/safety/legal status.

No Verification of Campaign Information: We don’t check details provided by Organizers nor guarantee donated funds will be used exactly as described;
neither do we verify compliance with laws regarding usage of funds.

Your Registration Obligations: To access certain Service features,
you might need to register with us providing true & current info about yourself per registration prompts.
Organizers must sign up under real names/images showing who they are genuinely representing their campaigns.
Our Privacy Policy governs how your registration data is handled. Under-13 users can’t use or register at all;
users under 18 require parental approval before accessing anything whether registered or not.

Some services might also need separate registrations/agreements directly through third-party providers like payment processors;
while we may help facilitate this process sometimes, we’re not liable for how those third parties perform.

Public Display of Donations: When donating,
donors can choose whether their donation appears publicly visible on campaign pages
or shared privately with campaign beneficiaries only. To keep donations private just tick off privacy boxes during checkout.

Check out our Privacy Policy for more details on how your info might get collected/used/stored when using our site.

Payment of Donations: To give money toward campaigns,
donors must supply valid credit card details (VISA/Master Card/Discover/American Express) or other approved payment methods.

Donors guarantee that their info is accurate & that they’re authorized users of said cards/methods.

Minimum donation amounts might apply; once made donations cannot be refunded.

Donors promise to keep payment info updated & pay all specified amounts promptly.

By donating through us repeatedly over time until canceled via platform settings,

donors authorize us to bill cards/payment methods ahead periodically accordingly.

Fees: There’s no upfront charge for organizers starting campaigns;

however we keep 4% (“Front Runner Professional Fee”) from each donation received

plus additional fees charged by third party processors (“Processing Fee”).

By donating, you accept terms set by these processors alongside ours.

Processor fees differ based on user location:

        • For US users ONLY:
Processors charge 2.9% + $0.30 per donation for VISA/Master Card/Discover,

Or 3.4% + $0.30 per donation if American Express cards are used.

        • For CA users ONLY:

Same fee structure applies as above;

All Fees mentioned get taken directly out from each Donation amount

meaning organizers see less than total donated sums withdrawn.

Fees could change over time; we’ll notify changes either online

at least two weeks before applying them where possible.

Continuing usage following fee updates means acceptance thereof.

Indemnification:
You agree to protect and hold harmless Company along with affiliates,

officers & employees against claims/losses/damages including attorney costs,

arising because of your actions violating rules here OR harming others’ rights.

California residents waive Civil Code Section 1542 which restricts releases covering unknown claims;

others waive similar local laws too.

DISCLAIMER OF REPRESENTATIONS AND WARRANTIES:
Using Service is entirely at your risk;

it’s offered “as-is” without guarantees about accuracy/timeliness/security/reliability/etc.

No promises about uninterrupted availability,

outcome results from using it,

correctness in sending donations fully onward,

nor quality standards overall applied here either.

LIMITATION OF LIABILITY:

Neither Company nor affiliates shall owe damages beyond what you’ve paid us within six months capped at $100 total even if errors occur;

no responsibility arises for indirect losses like lost profits/data/use etc., even when warned beforehand.

EXCLUSIONS:

Some places legally forbid exclusion clauses like these;

if unhappy with services offered/certain terms your only option remains stopping usage altogether

DISPUTE RESOLUTION – ARBITRATION (READ CAREFULLY):

You agree disputes go into arbitration instead of court lawsuits except small claims allowed separately;

Claims start after sending written Notice describing problem & demands addressed both by mail/email listed below:

Address:
 2501 Parmenter Street Suite 300A Middleton WI 53562 Attn President

Email:
support@tributepayments. com

If issues aren’t fixed within sixty days post-notice,

either side may begin arbitration under AAA rules modified slightly here;

Arbitration hearings usually happen in Chicago Illinois unless agreed otherwise;

Arbitrators decide everything including whether arbitration itself applies;

Both sides can’t file class actions jointly-only individual claims allowed unless mutually waived in writing;

Find AAA Rules online at adr. org / call AAA toll-free / write Notice address

During arbitration offers made stay secret until decision finalized explaining main reasoning clearly
