These Terms and Conditions apply to the Book Of Memories websites (the “Website”)
and related services (together called the “Services”). Front Runner Professional (“Company,” “we,” “us,” “our”) reserves the right at any time to change or update these Terms and Conditions in whole or in part.
Any updates will be marked with a date showing when they were last changed.
Most changes will take effect no sooner than fourteen (14) days after posting; however, updates tied to new features or legal reasons may be effective immediately.
Continuing to use the Services after any changes means you accept those changes fully.
Eligibility: If you’re under 18, you can’t use the Services unless you have permission. Kids aged 13 to 17 can use it only if a parent or guardian over 18 supervises and agrees to these terms, taking responsibility for your use. We can refuse service or cancel Campaigns, Donations, or access anytime for any reason without being liable.
Definitions: In these Terms, “Campaign Organizers” are folks raising money through “Campaigns.” “Donors” are people giving money via “Donations.” Together with other visitors using the Services, they’re called “Users.” This also includes anyone named as a beneficiary of Campaigns.
Services: The Services act as a platform (“Platform”) where Campaign Organizers post their campaigns seeking Donations from Donors. Setting up a Campaign is free but each Donation has fees taken out for our Service and third-party payment processors. We might change or stop the Services temporarily or permanently without notice and won’t be responsible if that happens. We’re not liable if data is lost while using the platform. Using mobile devices might mean extra charges from your carrier; some features might not work on all devices or networks. By using our Services on mobile, you accept we can send messages like SMS about updates and info related to your account usage.
Charitable Giving: Keep in mind that Campaigns aren’t registered charities offering tax-deductible donations. Donations may go through outside business partners who charge processing fees on top of ours (“Front Runner Professional Fee”). Company isn’t a charity nor does it ask for charitable donations for itself or others – we just handle payments between Donors and Campaign Organizers here.
Administrative Platform Only: We only provide an administrative role here – facilitating payments between Donors and Campaign Organizers but not involved in agreements between them directly. We aren’t agents, financial institutions, creditors or insurers for anyone using this service; we don’t control how campaigns run or what organizers say so we can’t be held responsible for outcomes of any campaign’s success or failure either way. You decide whether to donate at your own risk & should check out organizers yourself before donating since we do not guarantee how funds get used. We don’t vouch for quality, safety, or legality of any campaigns either. You’re responsible for how donations affect taxes too.
No Verification of Campaign Information: We don’t verify what campaign organizers post nor guarantee donations will be spent exactly as intended by them. We disclaim responsibility regarding adherence to laws governing such uses.
Your Registration Obligations: You might need an account with us to access certain parts of our Services. If registering, please give true & current info about yourself as asked during sign-up. Campaign Organizers must provide real names & images representing themselves honestly. Your registration info is handled according to our Privacy Policy. if you’re under 13 years old, yep, sorry – no usage allowed even if registered. if you’re under 18, a parent/guardian approval is required anyway before using services whether registered or not.
Some parts might also require signing up separately with third parties like payment companies -– if so, – while we may help set that up,&nbs pwe’re not part of those contracts & amp; amp; amp; amp; amp; amp; amp; nbs pdisclaim liability there either.
We may share info with those providers just enough so everything works smoothly.
Public Display of Donations: When donating,& nbspyou can choose whether your gift shows publicly beside other donors’ names or remains private just between you & amp; bsp ; the campaign recipient(s).& nbsp Just tick the box during donation process if you’d rather keep it confidential.

Payment of Donations : To donate , you’ll enter card details ( VISA , Master Card , Discover , American Express ) or another payment method. You confirm these details are yours & amp ; authorized by you. Minimum amounts may apply ; once paid , gifts can’t be refunded. Please keep payment info current & amp ; pay full amounts pledged. You authorize us bill periodically until stopping payments thru platform.
Fees : There are no upfront costs for starting campaigns here. However, we take 4% (“Front Runner Professional Fee”) off every donation plus fees charged by third party processors. Donors agree that by giving donations they accept all rules set by those processors along with ours.
Processor fees break down as follows:
// US Users ONLY : Processor charges 2.9% plus $0.30 per donation on VISA/Master Card/Discover cards ;3.4% plus $0.30 on American Express cards.
// CA Users ONLY : Same fee structure applies -2.9% plus $0.30 per donation on VISA/Master Card/Discover cards ;3.4% plus $0.30 per donation on Amex cards.
All Tribute Pay Fees together with Processing Fees (“Fees”) come straight out from each Donation amount-so what campaign organizers withdraw doesn’t include these deductions. We can change fees anytime but will give notice at least fourteen(14) days before new rates start. That said, your continued use means agreeing to updated fee schedule.
Indemnification : You agree protect and hold harmless Company including its affiliates, and their staff against losses , damages, costs(including lawyers’ fees), claims, and lawsuits arising from anything connected to your use, donations, campaign involvement, breach violations against us or others. If living in California, you waive Civil Code Section 1542 which basically says:”A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR”. Similarly, you waive comparable rights wherever else applicable.
DISCLAIMER OF REPRESENTATIONS AND WARRANTIES : USE OF SERVICES IS YOUR OWN RISK. Services provided “as-is” without promises. Company disclaims warranties including implied ones like merchantability, fair fitness, title, no infringement. No promise services fit needs, wont have interruptions, error-free, no guaranteed results, donation delivery, timeliness, nor quality assurances exist here.
LIMITATION OF LIABILITY : YOU AGREE COMPANY AND AFFILIATES ARE NOT LIABLE FOR INDIRECT OR SPECIAL DAMAGES INCLUDING LOST PROFITS EVEN IF WARNED. Possible claims covering contract, tort, etc. arising from using Or inability To Use Service, data breaches, mistakes, inaccurate statements Or actions Of Third Parties. In total liability capped at what you’ve paid company last six months, max $100.
EXCLUSIONS : Some places won’t let warranties/damage exclusions fully apply. So some limitations above mightn’t work everywhere. Satisfied? No? Your only option then stops using service altogether.
DISPUTE RESOLUTION – ARBITRATION (PLEASE READ) : Any disputes between You And Us Must Go Through Arbitration except small claims court cases. Notices must go To Address below And Email Support@tributepayments. com Explaining Issue And Remedies Wanted. If unresolved In Sixty Days Either Party May Start Arbitration. Financial offers remain secret Until Arbitrator Decides Settlement. Amount Will Follow AAA Rules Modified Here. By Default Hearings Held Chicago IL. Decisions Have Reasoned Written Explanations. YOU BOTH AGREE NO CLASS ACTIONS ALLOWED-only individual claims permitted. And If Class Action Ban Found Invalid Entire Arbitration Clause Voids Out.
