These Terms and Conditions cover how you can use the Book Of Memories websites (the “Website”)
and other related services (all together called the “Services”). Front Runner Professional (“Company,” “we,” “us,” “our”) reserves the
right to change or update these Terms and Conditions anytime at our sole discretion. Any updates will be noted with the date they were last changed.
Changes take effect no sooner than fourteen (14) days after posting unless they’re about new features or legal requirements, which take effect immediately.
If you keep using the Services after changes go live, that means you accept those changes.
Eligibility: If you’re under 18, you can’t use the Services without permission.
Users aged 13 to 17 may use it only if their parent or guardian who’s at least 18 agrees to these Terms and takes responsibility for their use.
The Company can refuse service or cancel any Campaign, Donation, or access anytime for any reason without liability.
Definitions: In these Terms and Conditions, “Campaign Organizers” are people raising money, while “Campaigns” refers to their fundraising efforts. Also, “Donors” are those giving money, and “Donations” means what they give. Everyone involved-Campaign Organizers, Donors, visitors-is called a “User.” The term also covers anyone designated as a beneficiary of a Campaign.
Services: Our Services provide a platform (“Platform”) where Users can post Campaigns to receive Donations from Donors. Setting up Campaigns is free but each Donation has fees taken out for our Services plus third party payment processors. We might change or stop offering Services anytime without notice and won’t be responsible if that happens or if any data gets lost along the way. Using mobile devices might mean extra charges from your carrier; some Services may not work on all devices/carriers too. When you use our Services on mobile, we might send messages about our offerings by SMS/MMS/text messages and receive info about how you’re using it too.
Charitable Giving: These Campaigns aren’t official charities so donations aren’t tax-deductible gifts. Some business partners process Donations with added fees beyond ours (“Front Runner Professional Fee”). We aren’t a charity ourselves nor do we ask for donations on behalf of others-we just handle payments between Donors and Campaign Organizers.
Administrative Platform Only: We’re basically just facilitating payments between Campaign Organizers and Donors – we’re not involved in agreements between them in any other way like being an agent or financial institution. We have no control over what organizers do or say; therefore we’re not liable for anything related to campaigns’ success or failure.
Donors should decide carefully before donating-they need to ask questions & research if they want since Donations are given voluntarily at their own risk.
We don’t guarantee Donations will be used as promised nor endorse any campaign’s quality/safety/legal status.
How donors treat donations for taxes is completely up to them.
No Verification of Campaign Information: We don’t check information provided by organizers nor guarantee funds get used as described in campaigns.
Also we aren’t responsible for verifying compliance with laws regarding donations.
Your Registration Obligations: You might need to sign up with us before accessing certain parts of our Services.
If so, you agree to provide accurate info when registering – including real names & images if you’re an organizer.
Registration details follow our Privacy Policy rules.
Kids under 13 cannot register/use Services; those under 18 must have parental approval before doing so.
Some parts require registration with outside providers like payment processors; we help facilitate but aren’t liable for those third parties’ actions.
We may share info with such providers just enough to make services work smoothly for users.
Public Display of Donations: Donors can choose whether their donation shows publicly or just goes privately to campaign beneficiaries – simply tick/untick boxes during donation checkout if privacy is wanted.

Payment of Donations: To donate you’ll need to give us valid credit card/payment method info authorized by yourself
(VISA/Master Card/Discover/American Express).
Minimum donation amounts may apply; all payments are final with no refunds allowed.
Keep payment details updated so billing goes smoothly; ongoing payments can be stopped whenever by ending subscriptions through Platform.
Fees: No upfront fees charged when creating Campaigns but we keep four percent (4%) from each Donation as “Front Runner Professional Fee.” On top of that there’s a Processing Fee paid directly by third party payment companies per transaction:
• US Users ONLY: Third party processor charges 2.9% + $0.30 per Visa/Master Card/Discover donation; American Express cards cost 3.4% + $0.30 per donation.
• CA Users ONLY: Same fees apply as US users above.
All Fees come out directly from each Donation before organizers see funds-so withdrawals reflect net amount after deductions.
Fees might change sometimes but if they do we’ll notify either here on website or elsewhere at least two weeks ahead before taking effect.
Continuing service after fee changes means accepting new fee terms.
Indemnification : You agree to protect Company plus its affiliates/employees/officers etc., from losses/costs/lawsuits related
in any way your Service usage , donations made , breaking rules , or hurting anyone else’s rights.
California residents waive Civil Code Section 1542 about unknown claims during release. Others waive similar local laws.
DISCLAIMER OF REPRESENTATIONS AND WARRANTIES : Use Service entirely at your risk.
It’s offered “as is” without guarantees. Company disclaims implied warranties including merchantability , fitness etc.
No assurance Service meets needs , works perfectly/timely/securely/errors-free,
results/donations reach intended recipients ,
nor quality standards overall.
LIMITATION OF LIABILITY : Understand Company & affiliates aren’t responsible
for indirect / incidental / special / consequential damages including lost profits/goodwill/data even when warned beforehand.
Total liability capped at max amount paid in last six months but never exceeding $100 total.
EXCLUSIONS : Some places forbid excluding warranties/liabilities mentioned so limitations above might not always apply.
Unsatisfied? Stop using Service-that’s your only remedy.
DISPUTE RESOLUTION – ARBITRATION (READ CAREFULLY) : You agree disputes will be settled through arbitration rather than courts except small claims court allowed.

Arbitration follows AAA Rules modified here available online/by phone/address listed ;
Hearing usually held Chicago Illinois unless both sides agree otherwise ;
Arbitrator writes clear decision explaining outcome ;
Claims must be brought individually – no class actions allowed unless mutually agreed otherwise ;
If individual-claim-only rule invalidated entire arbitration clause voided.
