PLEASE MAKE SURE TO READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE (AS DEFINED BELOW).
By using this Site, you agree that you have read and accept these Terms and Conditions.
If you don’t agree with these Terms and Conditions, PLEASE DO NOT use this Site (as defined below).
These Terms and Conditions apply to your use of the Book Of Memories websites (the “Site”)
along with other related services (together, the “Services”). Front Runner Professional (“Company,” “we,” “us,” or “our”) reserves the
right at our sole discretion to update, change or modify (the “changes”) all or part of these Terms and Conditions at any time for any reason.
Whenever changes happen, we’ll note the date when these Terms were last updated.
Changes will take effect no sooner than fourteen (14) days after posting; however, updates related to new Service features or legal requirements will be effective immediately.
Continuing to use the Services after such updates means you accept the revised Terms and Conditions.
Eligibility: People under 18 can’t use the Services without permission.
Those aged 13 to 17 can use it only if a parent or guardian over 18 agrees to oversee their use and accepts these Terms. The Company may refuse access or suspend Campaigns, Donations, or Services anytime for any reason without liability.
Definitions: Here, “Campaign Organizers” are those running fundraisers (“Campaigns”), while “Donors” are those giving money (“Donations”). All Campaign Organizers, Donors and visitors are called “Users”. Also included as Campaign Organizers are individuals designated as beneficiaries of Campaigns.
Services: Our Services act as a platform (“Platform”) for Users. They let Campaign Organizers post Campaigns so Donors can contribute funds. There’s no fee to create a Campaign but we do take a cut from each Donation for our services plus fees charged by third-party payment processors. We might change or stop Services temporarily or permanently with or without notice. We aren’t responsible if data is lost or deleted from our system.
You should know that using our mobile version may involve charges from your wireless provider like data fees etc., and not every carrier supports all features.
By using our Services on mobile devices, you agree we may send messages via SMS/MMS/text about Company info and your usage details.
Charitable Giving: These Campaigns aren’t charities where donations qualify as tax deductions.
When you donate through us, an independent partner processes payments taking their own fee besides ours.
We’re not a charity ourselves nor do we ask for donations on behalf of any charity – just acting as payment facilitators here.
Administrative Platform Only: Our role is simply handling payments between Donors and Campaign Organizers – we’re not part of their agreements.
We’re not brokers, agents, banks, creditors nor insurers for anyone using this site.
We have no control over how Campaign Organizers behave or what info they share – so we aren’t liable for anything connected with them.
We don’t promise that campaigns will succeed – donors decide whether to give based on their own judgment.
You must ask questions yourself before donating because Donations carry risk entirely on donors’ shoulders.
We cannot guarantee your donation gets used exactly how organizers say it will be used.
Also note that we don’t endorse nor vouch for quality/safety/legality of campaigns here – tax treatment is up to donors too.
No Verification of Campaign Information: We do not check facts provided by Campaign Organizers nor confirm if Donations get spent according to intended purposes.
We disclaim responsibility for making sure funds follow laws.
Your Registration Obligations: Some parts of our Services require registration with us first.
If you sign up, you must provide accurate current info about yourself as requested during registration including real name/image if you’re an Organizer.
Your info is handled per our Privacy Policy.
Under-13’s cannot register or use Services at all; under-18’s need parental approval even then.
Certain Service features may need accounts with third parties like payment processors who have their own terms which you must accept separately – we’re not responsible for those third parties’ actions but may share some info needed between them.
Public Display of Donations: When donating, you can choose whether your donation shows publicly or just goes directly to campaign beneficiaries privately. If privacy is preferred, tick the box during donation checkout. For more on how we collect/store info see Privacy Policy.
Payment of Donations: To give money, you’ll have to provide valid credit card details (Visa/Master Card/Discover/American Express)or other accepted methods. You promise this info’s true & that you’re allowed to charge it. Some minimum amount might apply. All payments are final, no refunds. Please keep your payment info updated. You also allow us charge your card regularly until you cancel recurring payments.
Fees: No upfront fees charged when creating campaigns, but we keep four percent (4%) from each Donation (“Front Runner Professional Fee”). On top, we pay third party processors who deduct their own fees:
- US users pay 2.9% + $0.30 per donation on Visa/Master Card/Discover; 3.4% + $0.30 on American Express
- Canadian users pay same rates as US listed above
All Fees come straight out from each Donation before organizers get paid. We reserve rights to adjust Fees anytime but will notify ahead by website notice at least 14 days before changes take effect. Keeping using services means accepting new Fees.
Indemnification: You agree to protect Company & affiliates including employees etc., against any losses, costs, lawsuits, involving injuries, deaths related in any way with your Service usage, Campaigns/Donations made, your breach of rules,& violation against others. If you’re from California, you waive Civil Code Section 1542 (“A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE…”). Others waive similar local laws too.
DISCLAIMER OF REPRESENTATIONS AND WARRANTIES: YOU USE THIS SERVICE ENTIRELY AT YOUR OWN RISK. IT’S PROVIDED “AS IS” WITHOUT ANY PROMISES OR GUARANTEES FROM COMPANY INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, TITLE OR NON-INFRINGEMENT. NO WARRANTY THAT SERVICES WILL MEET YOUR NEEDS, RUN WITHOUT INTERRUPTIONS OR ERRORS, YIELD ACCURATE RESULTS, DONATIONS REACH BENEFICIARIES OR QUALITY OF SERVICES IS GIVEN.
LIMITATION OF LIABILITY: YOU AGREE THAT NEITHER COMPANY NOR ITS AFFILIATES CAN BE HELD RESPONSIBLE FOR INDIRECT, SPECIAL, CASUALTY DAMAGES LIKE LOST PROFITS GOODWILL DATA ETC., EVEN IF WARNED ABOUT POSSIBILITY. WE ALSO LIMIT TOTAL DAMAGE PAYMENTS TO WHAT YOU PAID US IN LAST SIX MONTHS BUT NEVER MORE THAN $100.
EXCLUSIONS: SOME PLACES DON’T ALLOW LIMITING CERTAIN WARRANTIES OR DAMAGES SO PARTS ABOVE MAY NOT APPLY. IF YOU’RE UNHAPPY WITH OUR SERVICE/YOUR TERMS ONLY OPTION IS STOP USING IT.
