These Terms and Conditions cover your use of the Book Of Memories websites (the “Website”) along with other related services (together the “Services”). Front Runner Professional (“Company,” “we,” “us,” “our”) reserves the right at any time and from time to time, at our sole discretion, to update, change or modify (the “changes”) all or part of these Terms and Conditions for any reason. Any updates will show the date they were last revised. Changes will take effect no sooner than fourteen (14) days after posting; however, changes made for new features or legal reasons will apply immediately. Continuing to use the Services after those changes means you accept the updated Terms and Conditions.
Eligibility: People under 18 aren’t allowed to use the Services unless they have permission. Users aged 13 to 17 can use it if their parent or legal guardian who’s at least 18 agrees to supervise them; that adult must also agree to these Terms and take responsibility for their usage. The Company can refuse access or cancel any Campaign, Donation, or Service anytime without being liable for it.
Definitions: In these Terms “Campaign Organizers” are those running fundraising efforts (“Campaigns”). “Donors” are people giving money (“Donations”). Both Campaign Organizers and Donors plus anyone else visiting the Services are called “Users.” Also, beneficiaries named in Campaigns count as Campaign Organizers here too.
Services: We offer a platform (“Platform”) where Users can interact with the Services. This lets Campaign Organizers create Campaigns so Donors can give Donations through it. Setting up a Campaign is free but each Donation includes fees charged by us and payment processors. The Company can change or stop any Service temporarily or permanently without notice. You accept that we’re not responsible if something happens due to changes or interruptions. We aren’t liable if data gets deleted or isn’t saved properly on our site. If you access via mobile device, your wireless carrier may charge normal data fees. Some parts might not work depending on your carrier/device. Using our Services means you allow us to contact you by SMS/MMS/text about Company info, and some info about how you use our Services might be shared with us.
Charitable Giving: Keep in mind that Campaigns aren’t charities offering tax-deductible donations. When you donate via our Platform, an unrelated business partner may process it taking processing fees alongside our own Front Runner Professional Fee. You understand that we’re not a charity nor do we ask for charitable donations ourselves; we just handle payments between Donors and Campaign Organizers.
Administrative Platform Only: Our role is strictly administrative – simply facilitating payments between Campaign Organizers and Donors but not entering into agreements with either party directly. We don’t act as brokers, agents, banks, creditors or insurers. We have no control over what organizers say/do so disclaim all liability around their actions. We make no promises about whether a campaign succeeds. Donors decide on their own whether to contribute after doing their own research. All donations are voluntary and given at donors’ own risk. We don’t guarantee funds will be used exactly as promised. No endorsement is made regarding quality/safety/legality of campaigns. Tax treatment of donations is up to donors alone.
No Verification of Campaign Information: We don’t check what information organizers provide nor do we confirm if donations get spent according to stated purposes. We hold no responsibility for checking compliance with laws about donation usage.
Your Registration Obligations: You might need an account with us before using some parts of the Services. When registering, provide true/current/complete info as requested by registration forms. Organizers must register using real names/images representing themselves accurately. Your registration info is covered under our Privacy Policy. If you’re under 13 years old you’re not allowed on our Services even if registered; If under 18 years old you need parental approval regardless of registration status; Some features require signing up with third-party providers like payment processors – while we help connect these services we’re not responsible for them; Info may be shared between us & such third parties solely for providing related services.
Public Display of Donations: Donors can choose whether their Donations show publicly or only go directly to campaign beneficiaries. To keep your donation private just tick off privacy options during checkout. Check out our Privacy Policy for details about how your info might be collected/stored/used when using our Site.
Payment of Donations: To donate you’ll give us credit card details (VISA/Master Card/Discover/American Express) or other accepted payment method. You promise this info’s correct & that you’re authorized on that card/method. Minimum donation amounts may apply & all donations are final – no refunds. Please keep your account info updated. By donating repeatedly through us you’re authorizing automatic billing until cancelled.
Fees: There’s no upfront fee charged by Company when starting campaigns. But we keep 4% from each Donation (“Front Runner Professional Fee”). Plus payment processors take their share (“Processing Fee”). By donating users agree also to terms set by those third party processors besides ours. Fees vary depending on location:
• For US users only: Payment processor charges 2.9% plus $0.30 per donation on VISA/Master Card/Discover cards; American Express cards cost 3.4% plus $0.30 per donation.
• For Canadian users only: Same fee structure as US – 2.9% + $0.30 per donation on VISA/Master Card/Discover; 3.4% + $0.30 per donation on American Express.
All Fees get taken out from each Donation before organizers withdraw funds. Fees could change occasionally – we’ll notify users at least two weeks before changes take effect unless immediate legal reasons apply. Continuing usage after fee updates means acceptance.
Indemnification: You agree to protect Company & affiliates including employees/officers/directors against losses/damages/legal costs arising from your actions while using Services, breaking rules here, violating others’ rights, causing claims/injuries/death linked in any way, etcetera. If you’re in California you waive Civil Code Section 1542 which basically says releases don’t cover unknown claims; Residents elsewhere waive similar rules too.
DISCLAIMER OF REPRESENTATIONS AND WARRANTIES: USING THE SERVICE IS YOUR OWN CHOICE AND RISK. THE SERVICES COME AS-IS WITH NO GUARANTEES WHATSOEVER FROM COMPANY OR AFFILIATES INCLUDING MERCHANTABILITY OR FITNESS FOR PURPOSES OR NON-INFRINGEMENT ETC., NOR THAT IT’LL BE UNINTERRUPTED OR ERROR-FREE, NOR THAT DONATIONS WILL REACH BENEFICIARIES OR WORK OUT AS EXPECTED.
LIMITATION OF LIABILITY : YOU AGREE COMPANY AND ITS AFFILIATES AREN’T RESPONSIBLE FOR INDIRECT DAMAGES LIKE LOST PROFITS OR DATA EVEN IF WARNED ABOUT POSSIBILITIES; TOTAL LIABILITY TO YOU WON’T EXCEED WHAT YOU PAID US IN LAST SIX MONTHS BUT NEVER MORE THAN ONE HUNDRED DOLLARS ($100).
EXCLUSIONS : SOME PLACES MAY NOT ALLOW LIMITING CERTAIN WARRANTIES OR DAMAGES SO SOME PARTS ABOVE MIGHT NOT APPLY TO YOU; IF YOU’RE NOT HAPPY WITH OUR SERVICES OR TERMS YOUR ONLY OPTION IS TO STOP USING THEM.
